Reading the Motion to Dismiss makes clear that the defence's argument will hinge on the intent behind "blockchain entry" in the original commit being "private key" and NOT "name". If the Judge sees through the implausibility of such a claim, or at least wants to give us a chance to explain why this twist does not make any sense then, I believe, we will have our day in court...

"Names and Values are attached to special coins"-> When people equate ‘special coin’ with the Token in ‘NFT’ misunderstandings occur. Tokens are forever attached to art for NFTs of all other chains but for Namecoin the special coin is ONLY special in that it is no longer treated as fungible NMC. The special coin is not the object of desire to collectors of Namecoin assets: every time a name is renewed a NEW special coin is used. Since the art is unique the special coin cannot be where the art resides.

An important distinction between property & deed must be made when considering Namecoin NFTs. A UTXO, the thing that transfers ownership b/w holders of public/private key pairs, is a DEED to property but NOT property itself. The property that the Namecoin blockchain was built to cryptographically secure ownership of, provided all recurring fees have been paid to the protocol, is a unique plot of digital space known as a Name. As such, Names, along with the history of Values associated to them, are the NFT property.
